- 1994: Uruguay Round Agreements Act: Not only did it seize works out of the public domain and put them under copyright (this was what was challenged in the recent Golan case), but it made it a criminal offense to bootleg concerts (audio or video).

- 1996: Anticounterfeiting Consumer Protection Act of 1996: Expanded racketeering laws to include criminal copyright infringement, as well as "trafficking" in computer software, documentation or packaging, as well as trafficking in movies or audiovisual works. Also let the government seize property associated with these activities (precursor to domain seizures...).
- 1997: No Electronic Theft (NET) Act: Decreased the threshold for what counts as criminal infringement (such as taking out the monetary profit requirement).
- 1998: Sonny Bono Copyright Term Extension Act: You should know this one. Expanded copyright terms by 20 years.
- 1998: Digital Millennium Copyright Act (DMCA): Again, you may have heard of it. Created anti-circumvention rules and the notice-and-takedown system for online infringement, among many other things.
- 1999: Digital Theft Deterrence and Copyright Damages Improvement Act of 1999: Massively increased statutory damages for infringement
- 2004: Intellectual Property Protection and Courts Amendments Act: Set up penalties (civil and criminal) for counterfeit labels, documentation and packaging in association with copyrighted goods (yes, separate from the content itself). Also lowered the bar to show willful infringement.
- 2005: Family Entertainment and Copyright Act: Criminalizes recording of movies in theaters and also lets theaters detain people merely suspected of recording in theaters. Criminalizes releasing a work online before it's been officially released (if it's "being prepared" for commercial distribution).
- 2008: Prioritizing Resources and Organization for Intellectual Property (PRO-IP) Act: Increased civil penalties for infringement. Increased government seizure & forfeiture powers (which is how the government currently justifies its questionable domain seizures) and created a job in the White House to focus on greater enforcement.

Der Artikel ist tatsächlich bemerkenswert, weil man so ziemlich das erste Mal den Eindruck haben kann, dass das (ja doch schon seit jahren proklamierte) Unbehagen mit dem Copyrightregime auf ein auf EU-Ebene politisch signifikantes Ohr gestossen ist. (heisst nicht, dass die ihr vorschwebenden änderungen dann nicht noch schlimmer werden, was ich vom tonfall her aber nicht glaube, und heisst auch nicht, dass das dann in de oder fr jenseits der piratenpartei auch nur als gefühl wahrgenommen wird, aber als ansage ist das ein echter hoffungsschein).

Oddly, there seems to be a direct correlation between the quest for sugar and spices to give flavor to our food and the quest to squeeze the flavorful bits and patterns out of the big data emitted by crowds of internet users. But instead of real spices, we have synthetic spices. It’s like the relationship between laughter and the laugh track added to television comedy. The algorithms that have been constituted as our selves try out all the possible permutations in advance and deliver a small selection set for us to consume. The jokes are provably funny, the laughter pre-laughed and all that’s left for us to do is click “ok.”

I have to admit that the whole thing seems amusing to me, and in some sense, screams of a scam by users against companies. As long as you can convince them you’re “influential” (whatever that means), you can get special treatment. Considering how frequently many companies have mistreated people, the idea that you can game a system (and most of these systems appear very gamable) and get special treatment has a bit of a poetic justice feel to it.

The other thing that makes me wonder about these sorts of things is that I don’t use all of these different communications platforms the same way or for the same reasons. I use Facebook and Twitter was a method of communicating, not of influencing people. Yet if suddenly these random and arbitrary scores become important, do I start thinking differently about how I use these tools? Do I suddenly have incentives to get a lot more followers who will repeat what I say because it might increase my “influence” score? Personally, I don’t care enough to do that, and it would probably ruin the benefits I get out of things like Facebook and Twitter, but it does make me wonder how attempts to define something that isn’t really definable leads to a change in how those tools are used.

Sie kann thematisiert werden, wie alles andere auch, so kann sich Wikipedia stichwortmäßig selbst thematisieren, aber die Unterscheidung von beobachtbarer und operationalisierbarer Selbstreferenz wird an die Umwelt ausgelagert, aus welcher sie die Differenzen bezieht, um sowohl Selbstreferenz als auch sich selbst thematisieren zu können. Mag die Wikipediaschaft auch alles Wissen dieser Welt versammeln, so kann sie mit all diesem Wissen in Bezug auf sich selbst einfach nichts anfangen; streng genommen heißt das, dass Wikipedia gar nichts weiß.
